The quality of care in nursing homes and other long-term care settings is a major concern for local, state, and national policy makers and is becoming an ever-pressing issue. Recent reports of poor conditions in nursing homes1 have captured national attention and raise questions not only for providers but also for the state and federal agencies responsible for ensuring quality of care in these settings. In 1986, the Institute of Medicine (IOM) Committee on Nursing Home Regulations issued its report Improving the Quality of Care in Nursing Homes. Its recommendations provided the basis for Congress to enact a major reform of nursing home regulations embedded in the Omnibus Budget Reconciliation Act of 1987 (OBRA 87). The legislation was refined through subsequent enactments in 1988, 1989, and 1990. The Health Care Financing Administration (HCFA) issued the enabling regulations in 1990, which were implemented in 1990 and 1991. The enforcement regulations were issued in 1994 and became effective in July 1995. OBRA 87, and its implementing regulations, substantially extended and reshaped the regulation of nursing homes aimed at improving the quality of care provided in these facilities.
