The fourth provision of the Code of Ethics emphasizes the nurses are responsible for maintaining competence to make safe decisions for their patients (Fowler, 2015). This means that nurses should maintain continuing education to utilize the best evidence based practice. Nurses should use clinical judgement and their continuing education knowledge to make ethical decisions. A nurse can also make decisions to refuse assignments that are beyond their scope and standards of practice. Ethical decisions are decisions that respect and benefit the patient, whom the nurse’s obligation is to. The Code of Ethics considers ethical principles such as fidelity, or making decisions that honor agreements made with the patient. Beneficence also guides decision making in choosing to do what benefits the patient the most. In addition, non-maleficence guides the nurse to make decisions in a way that would avoid the least harm to the patient.

One example of how I would use the Code of Ethics in ethical decision making would be during the delegation of tasks to assistive personnel. This relates back to Provision 4 of the Code that states that nurses have to be accountable for the decisions and actions during their nursing practice, and are held responsible for making sure that their actions (including delegation) are performed up to the expected standards of care (Fowler, 2015). Nurse’s must be aware of what nursing actions can be delegated to who, and know that a nurse can not delegate nursing activities that involve assessment or evaluation to assistive personnel (Fowler, 2015). Under the Code the nurse is responsible for delegating the right task to the right person, but then also for the supervision of that task and the ultimate results of that task (Hadddad & Geiger, 2018).
